Terms of Service

These Terms of Service ("Terms") are an agreement between you and New Tap Filters ("we," "us," or "our"). They govern your use of www.newtapfilters.com (the "Site") and any purchase you make from us (together, the "Services"). By using the Services or placing an order, you agree to these Terms, our Privacy Policy, Return Policy, and Shipping Policy, which are part of these Terms. If you do not agree, do not use the Services.
Please read Section 15 carefully. It requires most disputes to be resolved by individual binding arbitration instead of in court, and waives your right to a jury trial and to take part in a class action. You can opt out within 30 days as explained there.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, to make a purchase. By using the Services, you confirm that you meet this requirement and that the information you give us is accurate and complete.
2. Products and descriptions
We try to describe and display our products as accurately as possible. Colors and images may vary slightly depending on your screen. We do not guarantee that product descriptions or other content on the Site are error-free, complete, or current.
Water filtration products. Filter performance depends on your local water quality, water pressure, correct installation, and replacing filters on schedule. Unless a specific certification is stated on the product page, our products are not certified to remove every contaminant, and results vary. Our products are not intended to diagnose, treat, cure, or prevent any disease, and statements on the Site have not been evaluated by the Food and Drug Administration. If you have concerns about the safety of your water, have it tested and consult your local water utility or a qualified professional. Always follow the included installation and use instructions.
3. Pricing and availability
All prices are in U.S. dollars. Prices and availability may change at any time without notice. If a product is listed at an incorrect price or with incorrect information because of an error, we may refuse or cancel orders for that product, even after an order has been confirmed. If we cancel an order you have already paid for, we will refund you in full.
4. Orders
Your order is an offer to buy. We may accept, limit, or cancel any order for any reason, including suspected fraud, resale, errors, or limited stock. Your order confirmation email does not mean we have accepted your order; acceptance happens when we ship it.
5. Payment
You agree to pay all charges for your order, including product price, shipping, and applicable taxes. You confirm that you are authorized to use the payment method you provide. Payments are processed by third-party payment processors, and your payment information is subject to their terms.
6. Shipping, returns, and refunds
Shipping is covered by our Shipping Policy. Risk of loss passes to you when your order is delivered to the carrier. Returns and refunds are covered by our Return Policy, which includes a 25% restocking fee on eligible returns and requires the buyer to pay return shipping, except for items that arrive damaged, defective, or incorrect.
7. Promotions and discount codes
Discount codes and promotions are subject to their stated terms, have no cash value, cannot be combined unless stated, and may be changed or ended at any time.
8. Marketing messages
If you sign up for our emails or text messages, you agree to receive recurring marketing messages from us, which may be sent using automated technology. Consent is not a condition of purchase. Message frequency varies, and message and data rates may apply. Reply STOP to opt out of texts or HELP for help, and use the unsubscribe link to stop emails.
9. Reviews and content you submit
If you submit reviews, photos, comments, or other content, you give us a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, edit, and display that content in connection with our business, including in advertising. You confirm that your content is truthful, that you own it or have permission to share it, and that it does not violate anyone's rights or the law. We may remove any content at our discretion.
10. Intellectual property
All content on the Site, including text, images, logos, videos, and designs, is owned by us or our licensors and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from it without our written permission.
11. Prohibited uses
You agree not to use the Services to: break any law; infringe anyone's rights; submit false information; buy products for unauthorized resale; interfere with or disrupt the Site or its security; use bots, scrapers, or other automated tools without our permission; or upload viruses or harmful code. We may suspend or end your access if you violate these Terms.
12. Third-party links and services
The Site may include links to or tools from third parties. We do not control and are not responsible for third-party websites, products, or services, and your use of them is at your own risk and subject to their terms.
13. Disclaimer of warranties
EXCEPT AS EXPRESSLY STATED IN WRITING BY US OR IN ANY WRITTEN WARRANTY INCLUDED WITH A PRODUCT, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT GUARANTEE THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Some states do not allow the exclusion of implied warranties, so some of the above may not apply to you.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, EMPLOYEES, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES OR A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT THAT GAVE RISE TO THE CLAIM.
Some states do not allow these limitations, so they may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
15. Dispute resolution and arbitration
Informal resolution first. Before filing any claim, you agree to email us at contact@newtapfilters.com with a description of the dispute and give us 30 days to try to resolve it.
Binding arbitration. If we cannot resolve the dispute informally, you and we agree that any dispute arising from these Terms, the Services, or any product will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court. The arbitration may be held by video or phone, or in the county where you live. Either party may instead bring an individual claim in small claims court if it qualifies.
CLASS ACTION AND JURY TRIAL WAIVER. YOU AND WE AGREE THAT CLAIMS MAY BE BROUGHT ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION, AND BOTH PARTIES WAIVE THE RIGHT TO A JURY TRIAL.
Opt-out. You may opt out of this arbitration agreement by emailing contact@newtapfilters.com within 30 days of first accepting these Terms, with your name, address, and a clear statement that you opt out of arbitration.
If any part of this section is found unenforceable, the rest will still apply, except that if the class action waiver is found unenforceable, this entire arbitration section will not apply to that claim.
16. Indemnification
You agree to defend, indemnify, and hold us harmless from any claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Services or products, or your violation of any law or the rights of others.
17. Governing law
These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, including the Federal Arbitration Act, without regard to conflict of law rules. Subject to Section 15, any legal action will be brought in the state or federal courts located in Brevard County, Florida.
18. Changes to these Terms
We may update these Terms at any time by posting the updated version on the Site and changing the "Last updated" date. Changes apply to orders placed and use of the Services after they are posted.
19. General
These Terms, together with the policies linked above, are the entire agreement between you and us about the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. You may not transfer your rights under these Terms; we may transfer ours. We are not responsible for delays or failures caused by events beyond our reasonable control.
